Travels With Kip Limited – Terms & Conditions

1. General Overview
Travels With Kip Limited (“the Company”, “we”, “our”, “us”) purchases its accommodations, transport, and related services from independent suppliers who are not under our direct control. All such suppliers are independent contractors. However, we ensure that all partners and suppliers are duly licensed and hold valid Health & Safety Certificates in accordance with the laws of Kenya.
We make every effort to ensure the smooth operation of all safaris and tours. However, we shall not be held responsible for any delay, interruption, or alteration of services arising from causes beyond our reasonable control, including but not limited to natural disasters, strikes, civil unrest, pandemics, or government regulations.
2. Reservations
All reservations must be made in writing with as much notice as possible.
Group / FIT Bookings:
– A non-refundable deposit of 30% of the total tour price is required upon confirmation if made more than 90 days before departure.
– Reservations made within 60 days of the departure date require a 50% deposit at the time of booking.
– The balance of payment is due 30 days prior to departure or by the date stipulated on the invoice.
Failure to make payment within the specified period may result in automatic cancellation of the booking without refund.
3. Cancellations and Amendments
All cancellations must be submitted in writing and are effective on the date received by Travels With Kip Limited.
Cancellation fees are based on the total tour price and apply as follows:
More than 90 days before departure – 15%
90 – 45 days before departure – 35%
45 – 29 days before departure – 50%
30 – 15 days before departure – 70%
Less than 15 days before departure – 100%
No refunds will be given for late arrivals, no-shows, or unused services.
By Travels With Kip Limited:
In the unlikely event that the Company must cancel a tour, it will make every effort to offer an alternative arrangement. If this is not possible, all payments received will be refunded in full. The Company will not be liable for any additional costs incurred by passengers.
Force Majeure:
The Company shall not be liable for loss or damage arising from circumstances beyond its control, including but not limited to war, terrorist activity, pandemics, civil unrest, natural disasters, government actions, flight disruptions, or any event that makes it impossible to operate as planned. We recommend clients obtain comprehensive travel insurance covering such events.
4. Pricing and Payment
All prices are quoted in United States Dollars (USD) unless otherwise stated. Prices are subject to change due to exchange-rate fluctuations, increases in taxes, park fees, transportation costs, or supplier rate changes.
Payments are accepted at the prevailing exchange rate on the date of receipt. All bank charges and transfer fees are the responsibility of the sender. Once full prepayment is received, no adjustment to the tour price will be made.
5. Refunds
No claims for refunds will be accepted for unused services, no-shows, or last-minute cancellations. Where feasible, Travels With Kip Limited will assist in securing refunds from suppliers, but cannot guarantee recovery of any costs.
6. Insurance
All passengers are strongly advised to obtain comprehensive travel insurance covering:
– Trip cancellation and curtailment
– Medical and evacuation expenses
– Baggage and personal effects loss or damage
– Accidents, delays, or force-majeure events
If travel insurance is unavailable in the passenger’s country of origin, the Company can assist in arranging suitable cover prior to arrival in Kenya.
7. Luggage and Personal Effects
Luggage and personal items are carried entirely at the owner’s risk.
Standard baggage allowance:
– 20 kg for overland safaris
– 15 kg soft bag for internal/charter flights
Travels With Kip Limited accepts no responsibility for loss or damage to baggage. Clients are encouraged to insure all personal belongings.
8. Visas, Health & Travel Documents
Passengers are responsible for ensuring that all travel documents (passports, visas, vaccination certificates, and driver’s licenses) are valid and compliant with the requirements of Kenya and other destinations visited.
Passports must be valid for at least six (6) months beyond the intended date of departure. Travels With Kip Limited is not liable for delays or losses arising from incomplete or incorrect documentation.
9. Accommodation
We will always strive to provide the requested accommodation. However, we reserve the right to substitute hotels, lodges, or camps of similar standard when necessary.
Single Accommodation:
Single rooms are limited and subject to availability. Supplementary charges apply.
Shared Accommodation (for Groups):
Shared accommodation will be arranged whenever possible based on passengers’ requests. The Company reserves discretion to allocate rooms where necessary, without liability.
10. Special Requests
Requests for specific meals, room types, or special assistance must be made at least 30 days prior to travel in writing. While every effort will be made to accommodate such requests, they cannot be guaranteed.
11. Transportation & Guides
All transportation services are subject to traffic, weather, and other operational conditions.
Travels With Kip Limited uses only licensed and registered driver-guides, including language-specific guides upon request (subject to availability).
12. Wildlife & Safety
Safaris often take place in areas inhabited by wild animals. Passengers participate at their own risk and must always follow guide instructions. The Company shall not be liable for any injury or incident resulting from wildlife encounters.
13. Responsibilities & Liability
Travels With Kip Limited acts as an agent for hotels, airlines, and other service providers. While every care is taken, we shall not be liable for injury, loss, delay, or damage arising from negligence, acts, or omissions of any third party.
We reserve the right to alter or cancel any part of the itinerary for safety, operational, or other reasons beyond our control. Additional costs arising from such changes shall be borne by the passenger.
14. Data Privacy & Confidentiality
We respect your right to privacy and handle all personal data in accordance with the Kenya Data Protection Act 2019 and GDPR for international clients.

15. Amendments, Severability & Entire Agreement
The Company reserves the right to amend these Terms & Conditions at any time. Updates will be posted on www.kiptravels.com and will take effect immediately.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.
These Terms & Conditions constitute the entire agreement between the client and Travels With Kip Limited and supersede all prior discussions or communications.
16. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya.
Any disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
